Form of ownership of the Museum of the History of the City of Kyiv

THE MUSEUM OF THE HISTORY OF THE CITY OF KYIV (hereinafter - the Museum) is a non-profit cultural institution based on the communal property of the territorial community of the city of Kyiv and subordinate to the Department of Culture of the executive body of the Kyiv City Council (Kyiv City State Administration). The owner of the Museum is the territorial community of the city of Kyiv, on behalf of which the Kyiv City Council acts. The organizational and methodological management of the Museum is carried out by the Ministry of Culture of Ukraine as the central body of executive power, which ensures the formation of state policy in the spheres of culture and arts.

The main direction of the museum's activity

The museum is a research, cultural and educational institution designed for the study, storage, use and popularization of monuments of history, material and spiritual culture, the involvement of citizens in the Ukrainian historical and cultural heritage, and the formation of the national consciousness of the Ukrainian people. The profile of the Museum is historical.

Organizational structure of the museum

The organizational structure and staff list of the Museum are determined by its General Director within the limits of the proven salary and staffing fund and are approved by the Department of Culture of the executive body of the Kyiv City Council (Kyiv City State Administration).

The Museum has branches that are not legal entities and operate on the basis of the Regulations approved by the General Director of the Museum in agreement with the Department of Culture of the executive body of the Kyiv City Council (Kyiv City State Administration):

  • Literary and Memorial Museum of Mikhail Bulgakov - (Andriivskyi Uzviz, 13-a, Kyiv);

The museum can create self-governing bodies: scientific, supervisory, methodical, museum-pedagogical, artistic, restoration and other councils, involving specialists of various profiles in their activities, as well as a permanent consultative and advisory body - the stock and purchase commission.

Accounting and preservation of museum collections

The Museum's collections are divided into main and auxiliary funds.

Monuments of history and culture, which are threatened with destruction or damage, may be removed from the Museum in accordance with the legislation of Ukraine.

Accounting, protection, storage, preservation, restoration of museum collections is carried out in accordance with the procedure determined by the legislation of Ukraine.

In the event of liquidation of the Museum, the monuments of history and culture are transferred to the relevant specialized museums in accordance with the procedure approved by the Resolution of the Cabinet of Ministers of Ukraine of July 20, 2000 No. 1147 "On Approval of the Regulation on the Museum Fund".

Accounting and reporting

The museum carries out operational and accounting records of the results of its activities and provides financial, statistical and other reporting in accordance with the procedure established by the legislation of Ukraine.

Financial reporting of the Museum is provided to the Department of Communal Property of the City of Kyiv of the executive body of the Kyiv City Council (Kyiv City State Administration) in accordance with the established procedure.

Control, inspection of the production, financial and economic activity of the Museum is carried out in accordance with the procedure established by the legislation of Ukraine.

International activity

The museum participates in international cultural cooperation in the field of museum affairs on the basis of multilateral and bilateral agreements.

The Museum's participation in international cultural cooperation is carried out in the prescribed manner by: conducting joint scientific research based on the development and implementation of international scientific programs; implementation of mutual exchange of museum information, exhibitions, study of international experience of museum organization; conducting and participating in international conferences, congresses, symposia, exhibitions; organization of joint training of museum workers, development of publishing activities; implementation of other joint activities in accordance with the agreements, if it does not contradict the legislation of Ukraine and international treaties of Ukraine.

Foreign currency receipts are used by the Museum in accordance with the legislation of Ukraine.

When was the Museum of the History of the City of Kyiv created

The museum was created in accordance with the Resolution of the Council of Ministers of the Ukrainian SSR "On the Creation of the Museum of the History of the City of Kyiv" dated November 14, 1978 No. 528.

Legal status of the museum

The museum is a legal entity, has an independent balance sheet, a current account in national currency with the bodies of the State Treasury Service of Ukraine and other accounts in banking institutions, a seal, stamps, forms, etc.
The Museum is guided in its activities by the Constitution of Ukraine, the laws of Ukraine "On Culture", "On Museums and Museum Affairs", acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, decisions of the Kyiv City Council, orders of the Kyiv Mayor, orders of the executive body of the Kyiv City Council (Kyiv City state administration), orders of the director of the Department of Culture of the executive body of the Kyiv City Council (Kyiv City State Administration), other normative legal acts of Ukraine and these Regulations.
Full name of the Museum in Ukrainian: MUSEUM OF HISTORY OF THE CITY OF KYIV. Full name in English: MUSEUM OF KYIV HISTORY.

Main tasks and areas of activity

The main purpose of the Museum's activities is to attract citizens and legal entities to the national historical and cultural heritage, to meet the intellectual, cultural and aesthetic, general educational needs of the development of society, and to promote the national elevation and spiritual development of the state.

The main tasks of the Museum are: preservation, scientific collection, comprehensive research, popularization and use of museum monuments, which make up museum collections, for scientific and educational purposes; drawing up scientific concepts, thematic exposition plans, thematic structures of the Museum's exposition and exhibitions, scientific passporting of monuments of the museum collection, carrying out art and museological scientific research; preparation of articles, monographs, methodological developments on the main issues of the Museum's scientific activity, compilation of catalogs, booklets, art albums, their publication, organization; participation in scientific conferences, seminars; provision of presentation to visitors of monuments of folk art and works of professional artists of Ukraine, conducting tours of the Museum's expositions, reading lectures on the subject of museum collections; provision of restaurant services for the purpose of organizing recreation and leisure for citizens, provided the necessary production facilities and specially designated and equipped premises are available; conducting thematic evenings, master classes, creative laboratories, festivals of folk and professional art; provision of services for the organization and/or holding of cultural and mass and scientific events, professional and corporate holidays, international symposia, forums, scientific and practical conferences, biennials, plein airs, competitions, educational events (seminars, master classes, trainings, creative laboratories and workshops), seminars, workshops, meetings, concerts, festivals, exhibitions, performances, cultural and artistic events (projects) and the provision of other paid services that can be provided in accordance with the Resolution of the Cabinet of Ministers of Ukraine dated December 12, 2011 No. 1271 "About approval of the list of paid services that can be provided by state and communal cultural institutions".

To fulfill the tasks of the Museum, its activities are planned and carried out in the following directions: research work; scientific and educational activities; stock work (accounting and preservation); scientific-organizational and educational activities, in particular in the field of art education; monument protection activities; restoration, conservation and examination of museum exhibits; assembling the museum collection; exposition and exhibition activity; cultural and educational work; conducting scientific consultations and examinations; publishing activity.

The museum has the right in accordance with the established procedure: to independently plan its activities, to improve technology, forms and methods of work; perform transactions in accordance with the legislation of Ukraine; to create and open exhibition grounds and halls, sculpture parks and art galleries, information and exhibition halls and recreation and rehabilitation halls and complexes and other objects to meet the intellectual, cultural-aesthetic and general educational needs of citizens; prepare and conduct thematic, information-exhibition, literary-artistic and other programs; to show movies and videos; to carry out exhibition, scientific, recreational and economic activities on the territory of the Museum; design, create, install and assemble various complexes for cultural recreation of people; issue booklets, prospectuses, posters, badges, other products promoting the Museum's activities; organize exhibitions and sales of works of painting, graphics, sculpture, decorative and applied arts, souvenirs, books, flowers, collective excursions and lectures in various fields of knowledge; to hold seminars, holidays, theatrical performances, carnivals, balls, festivals, reviews, contests, free and paid concerts of professional and amateur groups both in their Museum and on contractual terms in other institutions and organizations with ticket sales; provide paid services to Museum visitors in agreement with the Department of Culture of the executive body of the Kyiv City Council (Kyiv City State Administration); to receive funds and material assets, including houses, buildings, equipment, vehicles from charitable organizations and associations of citizens, other legal entities and individual citizens; dispose of funds received from the provision of paid services, charitable contributions and funds received from other sources in accordance with the legislation of Ukraine; to carry out other activities in the field of culture.

Management of the museum

The Museum is managed by the General Director, who is appointed by the Director of the Department of Culture of the executive body of the Kyiv City Council (Kyiv City State Administration) by concluding a contract based on the results of the competition in accordance with the established procedure.

The General Director of the Museum: manages the activities of the Museum; hires and dismisses his deputies, heads of branches and other employees of the Museum in accordance with the legislation of Ukraine and approves their job descriptions; takes incentive measures and imposes disciplinary sanctions on employees; approves the Museum's work plans; performs transactions, concludes contracts, agreements on behalf of the Museum, signs documents related to the activities of the Museum, issues powers of attorney (mandate); ensures the submission of financial and statistical reporting in the prescribed manner and, together with the chief accountant of the Museum, bears personal responsibility for the reliability and timeliness of reporting in the manner prescribed by the legislation of Ukraine; ensures timely payment of taxes and other mandatory payments, in accordance with the legislation of Ukraine; submits for approval the Department of Culture of the executive body of the Kyiv City Council (Kyiv City State Administration) the cost estimate, the staff list of the Museum in accordance with the procedure established by the legislation of Ukraine; acts without a mandate on behalf of the Museum, represents its interests in state authorities and local self-government bodies, other organizations, in relations with legal entities and citizens, resolves issues of the Museum's activities within the limits and in the order determined by these Regulations; issues orders that are binding on the employees of the Museum; exercises other powers in accordance with the legislation of Ukraine and this Regulation.

Museum staff

The Museum's workforce consists of all citizens who participate in its activities, based on an employment contract (contract, agreement), as well as other forms that regulate the employee's employment relationship with the Museum.

The powers of the labor team are determined by the legislation of Ukraine.

The right to conclude a collective agreement on behalf of the employer is granted to the General Director, and on behalf of the labor team to the body authorized by him (trade union organization).

Property and funds of the museum

The property of the Museum belongs to the communal property of the territorial community of the city of Kyiv and is attached to the Museum with the right of operational management. Museum objects, collections, and gatherings secured by the Museum are part of the state part of the Museum Fund of Ukraine, are state property and are not subject to alienation, except in cases provided for by the legislation of Ukraine.

The property of the Museum consists of fixed assets and working capital, as well as other material and financial resources, the value of which is reflected in its independent balance sheet.

The Museum's funding sources are: funds from the budget of the city of Kyiv; funds received from economic activity, provision of paid services, including for visiting the Museum; funds received for research and other types of work performed by the Museum on the order of enterprises, institutions, organizations, associations of citizens and citizens; income from the sale of souvenir products, items of folk arts and crafts, publishing activities, from the leasing of premises, buildings, equipment; fees for filming and photography; grants, charitable contributions, voluntary donations, cash contributions, material assets received from individuals and legal entities, including foreign ones; funds received by the Museum as interest on the balance of its own income, received as a fee for services provided by them in accordance with the main activity, charitable contributions and grants and placed in current accounts opened in public sector banks; other sources, including currency receipts, in accordance with the legislation of Ukraine.

Funds received by the Museum are used by it in accordance with the procedure established by the owner or an authorized body, in accordance with the legislation of Ukraine.

The museum has the right only with the consent of the owner or a body authorized by him: to alienate the property secured by him, to provide it for rent or for free use (loan), to pledge real estate, equipment, inventory and other valuables, as well as to write off fixed assets from the balance sheet in in the established order.

The revenues (profits) of the Museum are used exclusively to finance expenses for the maintenance of the Museum, the realization of the purpose (goals, tasks) and directions of activity defined by these Regulations.

The distribution of received income (profits) or their part among the founders (participants), members, employees of the Museum (except for payment of their labor, calculation of a single social contribution), members of management bodies and other related persons is prohibited.

Termination of the museum

The museum is terminated as a result of reorganization (merger, merger, division, transformation) or liquidation by decision of the owner or the court in accordance with the procedure determined by the legislation of Ukraine.

Termination of the Museum is carried out by the termination commission, which is formed by the owner or the body that made the decision on termination. The procedure and terms of termination of the Museum, as well as the terms of filing claims by creditors, are determined by the owner or the body that made the decision to terminate the Museum.

 In the event of liquidation of the Museum, the procedure for further use of museum collections and funds shall be determined by the Kyiv City Council in agreement with the Ministry of Culture of Ukraine.

In the event of termination of the Museum, all assets are transferred to one or more non-profit cultural institutions or are included in the budget income.
